When Payroll Stops, the Business Does NOT Just Pause

ATTENTION: Australian Business Owners and Executives

RE: Payroll Continuity, Fair Work and Payday Super

When Payroll stops, the Business does NOT simply pause. Operations stall, trust erodes, and the pressure travels straight home. Australian Business Owners and Executives already carry the weight of modern Awards, Payday Super (in force since 1 July 2026), Single Touch Payroll (STP) +PLUS the Criminal Wage-Theft Provisions that have applied since 1 January 2025. You are NOT alone in that heavy load! Most Small and Medium Enterprises (SaME) face the same thin margins, key-person risk and limited specialist depth. [1] [2] [3]

RUNPAY® Advice Exists for EXACTLY this Conversation: Practical, Executive-level Guidance that keeps Payroll moving so the rest of the Business can keep moving too.

In this article, we will cover five (5) 'Critical' topics:

  1. Why Payroll continuity is narrower, and more urgent, than a 'General' Disaster Plan.

  2. Why Government Workplaces and SaMEs do NOT live in the same reality, and why size is NOT a shield.

  3. The Legal, Cash-flow and Family Consequences IF and WHEN a Pay Run fails.

  4. The Incidents that convert an Operational Problem into a Legal One AND a Household One.

  5. A clear Executive Action Plan, aligned to the RUNPAY® Templates already on our site.

If the next disruption is already forming, treat this as a Governance Checkpoint, NOT a reading exercise.

  1. Payroll Continuity Is NOT a 'General' Disaster Plan

Business Continuity from a Payroll perspective answers two (2) questions at once.

Can the Business still meet its Legal and Commercial Obligations? And can EVERY Worker still receive their usual pay, ON the usual day, AFTER the Disruption?

Miss the second and the first will usually collapse with it.

The Fair Work Act 2009 still requires payment of wages and entitlements in full, in money, and at the very least Monthly. A Cyber Outage, a Flooded Office, a Payroll Officer suddenly unavailable OR a Banking File that fails does NOT suspend THAT Duty. Workers still have Rent, Mortgages, School Fees and Groceries. The Legal and Human consequences land on the Same Small Leadership Team. [4]

Insight for Executives: A Continuity Plan that restores email in three (3) days, but CANNOT produce a Pay File on Thursday, HAS ALREADY FAILED THE ONLY TEST THAT MATTERS TO THE WHOLE WORKFORCE.

  1. Government Workplaces and SaME's Do NOT Share the Same Buffer

Public-Sector Agencies typically sit inside Larger Central Payroll, Treasury and Continuity Frameworks. Funding Streams are more predictable, Specialist Teams are deeper and a MISSED Pay Run is RARE because the Systems and Backups are institutional.

A SaME Owner often IS the Final Approver, the Cash-Flow Manager PLUS the Person who explains a delayed deposit to staff. There is NO automatic central buffer. One (1) person, one (1) system and one (1) Bank File can be the entire control environment.

That is why the Delegations Register on the RUNPAY® site is deliberately built to Map Position Titles to the Business Continuity Plan (BCP), SO APPROVALS DO NOT STALL when the 'Usual' Signatory is unavailable. Authority has to survive the absence of the person who usually exercises it. [8]

Size is NOT a shield. The Queensland Health Payroll Failure remains the clearest Australian proof. The replacement system went live on 14 March 2010 despite known defects and incomplete testing. Almost 78,000 staff received inaccurate pay, and at times, NO pay at all, for the months following. Overpayments and Underpayments EXCEEDED $300 MILLION.

The Commission of Inquiry later described the Project as among the Worst Failures of Public Administration in the Country. End-of-Project Cost reached about $181 million, with operating and REPAIR COSTS estimated at around $1.2 billion over eight (8) years. Overpayment recovery then pursued Employees for years. [10] [11]

Queensland Health had Institutional scale, Shared-Services machinery and a Prime Contractor. It still failed the two (2) questions above: Legal and Commercial obligations, and Pay on the 'usual' day. A SaME DOES NOT get a Commission of Inquiry. It gets the same Human outcome on a Balance Sheet that CANNOT absorb it. The downstream effects are concrete.

Late or incorrect pay triggers complaints, back-pay calculations, Fair Work Ombudsman investigations and, where the underpayment is intentional, criminal exposure. From 1 January 2025, intentional wage theft is a criminal offence under the Fair Work Act 2009. Penalties include up to ten (10) years’ imprisonment for individuals and fines of up to $8.25 million for Companies, or three (3) times the underpayment amount, whichever is greater. [1] [2]

Recent Fair Work Ombudsman recoveries show the scale of the problem even where INTENT is NOT the Story. The Ombudsman recovered $358 million for more than 249,000 underpaid workers in 2024–25, taking five-year recoveries past $2 billion. About 60 per cent of the 2024–25 recoveries came from Large Corporate Employers that, in many cases, 'BELIEVED' their Systems were compliant. [3]

Public headlines damage reputation and can accelerate cash-flow stress into insolvency, PUTTING EVERY JOB IN THE BUSINESS AT RISK. Internally, inconsistent application of Policies, a theme already covered in RUNPAY® guidance, multiplies the clean-up cost once Systems are restored. Policy, Award interpretation, system configuration and the amount that actually leaves the Bank have to say the same thing.

  1. The Same Disruption Follows People Home

XERO research released in May 2026, the Emotional Tax Return report, found that 38 per cent of Australian Small-Business Owners described their stress as Very or Extremely Severe, 31 per cent had Considered Walking Away from the Business and 58 per cent had Hidden that Stress from their Partner or Family. Nearly three-quarters said they could NOT switch off from work, and 34 per cent were losing MORE THAN five (5) hours of sleep a night. Xero also noted that Payday Super was landing on an already pressured time of year. [5] [6]

Separate Survey Reporting has long treated Cost-of-Living and Financial Pressure as a LEADING REASON Australians believe Couples Separate or Divorce. When a Pay Run fails or when an Owner spends weeks reconstructing underpayments and facing claims, the strain is financial and very emotional. Sleep disappears, patience shortens and children notice. Partners who are also Business Owners, or who rely on the single wage, absorb both the cash shortfall AND the mood in the house.

Common Patterns that convert an operational incident into a Family Crisis and a Legal one include:

  1. A key Payroll person resigning without handover;

  2. A cloud-provider or operating-system outage that freezes Time-and-Attendance and Banking files on the same day, as seen in the July 2024 Global IT Outage;

  3. A Natural Event that closes the premises while wages are still due;

  4. The discovery of historical Award errors that MUST be remediated while the Business is already under pressure; and/or

  5. A System Go-Live that proceeds with known defects, as Queensland Health did in 2010, turning one (1) Pay Cycle INTO YEARS of Overpayment Recovery and Underpayment Repair [10] [11]

Each one (1) can be survived. None of them though should ever be improvised on Payday.

Your Executive Action Plan

A Practical Payroll Continuity Plan prevents most of that cascade. It sits alongside the other RUNPAY® templates: Worker’s Handbook, WHS Policy, Delegations Register and records rules, so Authorities, Backups and Communication lines are already aligned. [8]

  1. Name Payroll as a 'Critical' function. Set a Recovery-Time objective measured in Hours, NOT Days. Document WHO can Run a Pay, WHO can Approve it and the fallback Bank Process IF the Primary System is down.

  2. Keep at least two (2) people OR one (1) Person PLUS a tested External Arrangement, able to produce an accurate Pay File. Store encrypted copies of the last successful file, Employee Bank Details and Award Interpretation Notes off the main System.

  3. Test the Plan twice a year, including a Payday Super scenario. Confirm Super can still reach funds within the seven (7) Business-day window and that STP can still be lodged. DON'T FORGET to leave enough time for Clearing-House Processing AND Rejected Payments. The Small Business Superannuation Clearing House closed on 1 July 2026, so the fallback path MUST be a current one. [7]

  4. Do NOT Go-Live OR Cut-Over, with Known Pay Defects (KPD) treated as 'Acceptable' Risk. Queensland Health’s Commission of Inquiry traced the failure in part to urgency, weak Governance and a Decision to proceed when the System was NOT ready. The same Discipline applies to an SaME Software Change. [11]

  5. Pre-agree Communication Wording for Staff AND for ANY Regulator. Silence creates MORE Claims than a Clear Statement that Pay WILL arrive tomorrow, by a named method.

  6. Align the Continuity Steps with your Delegations Register and Worker’s Handbook so Authority Limits and Confidentiality Rules still apply under pressure.

  7. Review Cash Reserves or a Short-term Facility sized to at least one (1) full Pay Cycle. Government Entities RARELY face this Personal Liquidity Test. SaME's DO.

  8. After any incident, RECORD WHAT FAILED and UPDATE the Plan. The same Discipline already required for WH&S Incidents and Records Retention applies here.

RUNPAY® Recommendation: Do NOT treat the 'Our Software has a Backup' as your evidence of Business Continuity. Treat a TESTED Payroll File, a TESTED Approval Path and a TESTED SUPER Payment as the evidence. QUEENSLAND HEALTH HAD A NEW SYSTEM. IT DID NOT HAVE A WORKING PAY RUN. You DO NOT have to design this from a Blank Page while the next Disruption is already forming. The RUNPAY® Business Continuity Plan (BCP) Template gives Australian Employers a Structured Starting Point (SSP) that can be tailored to your size, Awards AND Business Systems. It is available with the other Employer Templates at https://www.runpay.com.au/runpaytemplates. [8]

IF you want the Plan 'Pressure-Tested (PT)' against your Actual Payroll Setup, Book RUNPAY® Advice and work through the gaps with someone who spends every day on these EXACT Risks. [9]

Payroll Continuity is NOT an IT Appendix. It is exactly HOW you keep the Business solvent, the WORKFORCE PAID and the pressure from landing unbroken on the human(s) 'JUST' waiting at home.
